Showthemes is a trading name of Showthemes, a company incorporated in the State of Colorado, and a sister company of Imagely.

Before you sign up and download or use our themes for your own purposes, please make sure you have read, understood, and agreed to all the terms. By using our themes and/or other products, we assume you’ve accepted the terms of use given below.

These terms of use apply to all our themes. Showthemes grants you a lifetime license to use themes sold on the Showthemes.com website in accordance with the following terms and conditions.

1. Terms

We grant you a limited and non-exclusive right to use the Showthemes themes (subject to any other applicable licenses such as the GNU General Public License) solely for the purposes which our themes are intended for and as permitted by the licenses applicable to our themes components. This right is not transferable to any other person or entity.

This is a legal agreement between you (“Licensee”) and Showthemes. This agreement applies to licenses issued via the world wide web and is applicable to online delivery of licensed material. Your purchased or use of the Licensed Material’s License implies that you have read and accepted these Licensing Terms and Conditions.

Once you purchase one of our themes, you will receive a unique license key. Each license is valid for one year of updates and bug fixes. The new version of the themes will be easily upgradable from your WordPress dashboard. You can use our themes on as many domains as you wish.

Our products are licensed under the GPL (click here to find out more about the GPL http://www.gnu.org/licenses/gpl.html)

When you purchase our products, you will receive updates and bug fixes for one year. Additionally, if you purchase a Support License you will have access to a ticket-based Support HelpDesk for a period of one year. Please refer to our Support Terms for more details. You may renew the License and Support License on the anniversary of your paid License purchase. For more information about the Support Service, read below.

Some of our products have been contributed by 3rd Party service providers. These 3rd Party service providers may change from time to time and the Products they contribute may not always be available through Showthemes.

1.2 DEMO CONTENT

Re-use of any graphics, icons or photos from the demo content for any purpose is strictly prohibited. The demo content is for demonstration purposes only. Images from the demo website will NOT be distributed with the themes, or loaded with dummy data that come with the themes.

1.3 LICENSE OWNERSHIP

Showthemes holds the right to revoke license immediately anytime in future if we found the product is being misused by the customer.

1.4 PSD FILES

Theme purchases do NOT include PSD files. We do NOT provide PSD files with any of the single or bundle theme packages.

1.5 All Theme Bundle

All Theme Bundle purchase includes all the theme included in your invoice in a specific point of time. The All Theme Bundle does not include future release of themes. You will not receive new themes not originally included in the bundle.

1.6 Requirements

Our themes technical requirements are:
– the recommended WordPress requirements listed in the official requirements page
– some of our themes need the cURL extension
– some of our themes need the mbstring extension

All Theme Bundle purchase includes all the theme included in your invoice in a specific point of time. The All Theme Bundle does not include future release of themes. You will not receive new themes not originally included in the bundle.

2. Product Delivery

As soon as your payment has been confirmed, you will receive an email containing  a link to the download page and a license key to activate your product.  In case you have not received the email confirmation, please contact us using our support form. We will resend your download link and licence key manually. You can download each theme or each bundle one time only.

3. Payments

We accept payments via Paypal only, where you will be able to select your payment method including credit card.

4. Checkout Registration

We collect your personal and/or company information through the Website’s checkout form in order to successfully complete the checkout process. We process personal information in terms of the Data Protection Policy set out below.

You warrant that your personal and/or company information which you submit to us is accurate, current and complete. You also confirm that you have read and understand the Data Protection Policy set out below.

You agree that we may deny you use of our themes and/or Support Help Desk should you breach your warranty or subsequently be found to have breached this warranty. We may take steps to verify your personal information once you have completed the requisite registration process for Showthemes products and these steps may include, and are not limited to, email verification. You agree to submit to this verification process and irrevocably consent to us gaining access to relevant information held by 3rd Parties which may be reasonably required to complete the verification process. You acknowledge and agree that your access to Showthemes products may be limited until this verification process has been successfully completed.

Should you not agree to our verification process or withhold your consent to us processing your personal information, your Showthemes product use may be suspended or terminated.

Without limiting our liability limitation provisions below, you waive any claims you may have against us or our Associates in the event we deny you use of the Showthemes products where you have breached these Use Terms or otherwise failed to fulfil your obligations to Showthemes.

5. Support

We provide technical support for our themes through our Help Desk system in the members area, NOT by email. When you purchase any of our product, you will be required to register on our Help Centre in order to make use of your license. Once registered, you will be able to log into your account using your chosen usernames and passwords. You may not impersonate another person and you are required to associate your real identity with your account. If you did not purchase a Support License you will not be able to submit a ticket in the Help Centre.

We do not provide support for the Genesis Framework. If you wish to buy support for the Genesis Framework, please go to the Studiopress website. We do not provide general support for WordPress, please refer to WordPress Forum and Support website.

We do not provide customization of our themes. If you wish to customize one of our themes, we recommend Codeable.

6. Passwords and Account Security

You agree that the security of your Showthemes user account is solely your responsibility. You further agree that:

  • you are responsible for maintaining and promptly updating personal information and any other information you submit to us, keeping it accurate, current and complete;
  • if you believe your Showthemes user account’s security or integrity has been compromised in any way, you agree to notify us immediately and that you will be liable for any losses you suffer should you fail to notify us timely;
  • we reserve the right to suspend your Showthemes product/s pending an investigation and resolution if any security violations are believed to have occurred in association with your Showthemes user account
  • in case we are required to access your WordPress dashboard in order to provide support, you hereby agree that you will provide us with an exclusive temporary username and password (i.e. not ‘admin’ or ‘webmaster’ type login), that are not shared with anyone else other than our support team. You hereby warrants to delete the temporary account once your support ticket has been closed.
  • We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your or third party’s  misuse of the files downloaded from Showthemes website or mishandling of the temporary login details to your wordpress dashboard provided to us.
  • YOU AGREE TO INDEMNIFY US AGAINST ALL LIABILITIES, LOSSES, DEMANDS, DAMAGES, COSTS, CLAIMS, EXPENSES (INCLUDING LEGAL EXPENSES) AND INTEREST SUFFERED BY US, INCLUDING PAYMENT OF COMPENSATION TO A THIRD PARTY AND ITS EXPENSES IN SETTLING SUCH THIRD PARTY CLAIM, AS A RESULT OF ANY FAILURE BY YOU TO COMPLY WITH YOUR OBLIGATIONS IN ACCORDANCE WITH THESE TERMS.
  • If required, you agree to provide us with an exclusive, temporary account to access your WordPress dashboard. Accounts with simple usernames, like “admin”, “webmaster”, “root”, “temp”, and so on will NOT be accepted. We will not accept accounts with simple passwords. Passwords must have at least 10 characters, including at least one of each: upper case, lower case, number and symbol
  • The login details you provide to access your account for carrying out support investigations must be temporary. It is your responsibility to delete the account you created for us after the ticket is solved.

 

7. Ticketing & Registration

Our products do not provide ticketing or registration functionalities. A 3rd party, external registration or ticketing provider will be needed in order to cater for those services.

8. Fudge/Tyler/Vertoh Twitter Widget and Google Maps

In some cases Twitter.com does not show hashtags in results. If Fudge/Tyler/Vertoh’s Twitter widget shows tweets for a different hashtag than the one you are trying to use, then we will not be able to help.

Here is Twitter discussion about it, get in touch with them to request the hashtag to be displayed.

If Fudge/Tyler/Vertoh’s map widget is showing a random address, completely unrelated to your location (most of the times a small island in Africa), this is because your website is on a shared hosting platform. Google introduced limitations to the number of calls apps can make to their service. If your website share the same IP of a website that makes to many calls, you won’t be able to show the map. This is unless you change hosting arrangements. Unfortunately we will not be able to help with that.

9. Language Translations

Our themes are NOT multilanguage, i.e. no concurrent languages can be displayed. Nor they integrate with multilanguage plugins. We only offer translations for the .PO file. Any other multilanguage capability is not offered as part of our themes and our support does not include customization in this area.

10. Product Updates

We do not commit to release product updates. All bugs will be fixed if you are the holder of an active license key. Bug fixing does not include extending the functionality of the theme or asking for support, which is offered when you purchase our support license. It’s your responsibility to keep your installation of WordPress up-to-date.

11. WordPress & Theme Installation

Our themes require an intermediate knowledge of WordPress. You should be able to download, install and set up WordPress yourself, as a minimum requirement. We do not offer assistance on WordPress installation and set up other than with our VIP Package. Before purchasing our themes, make sure you know how to install and set up WordPress.

It’s your responsibility to keep your installation of WordPress up-to-date.

You are required to follow each theme’s specific Guide in order to ensure the proper installation and set up of your theme. The theme guide will be sent to you via email after you have purchased the theme. Each theme guide is relevant to a specific theme only and may not be appropriate for other themes purchased from us. You are required to follow the steps in the guide that’s relevant for that specific theme, unless specified otherwise.

12. VIP Installation Package

  • The service is valid for setup of one domain, one theme only. We won’t be able to install more than one theme on more than one domain. If you already have content on the site, please contact us first
  • Turnaround time is 5 business days (depending on you submitting all the information on time this can be brought down to 48hrs during business days)
  • This is not a customisation service, we cannot change theme files or customise the theme, we will just set it up for you
  • Purchasing one of the above packages does not let you any priority support. Standard support terms apply to the purchase after the setup
  • We can’t design your logo and other site elements. Design work is not included in any package
  • Upload of images is not included. You’ll need to upload images for all elements

13. Event Espresso Integration

We only support Event Espresso 4. Our integration with Event Espresso includes only the ticket selector. Speakers, Agenda and Sessions will be handled separately.

14. Refund Policy

All sales are final. No refunds will be given for themes that are delivered via digital download from our site. By purchasing one of our themes, you explicitly acknowledge that you do not have a right to cancel your purchase and obtain a refund once the download has started. If you have any difficulty downloading our products, we’ll try to fix it as soon as possible or you can contact us through the Help Desk.

15. Privacy and Data Protection Policy

Any information submitted by the buyer will be used solely for the purpose of completing the transaction, delivering the product, informing about new product releases, and addressing any customer service issues.

By using any part of the Website or providing personal information to us, you consent to us processing your personal information as set out in this Policy.

We use cookies which are files that store information on your hard drive or browser. Cookies can be used to determine whether you have visited the Website before and make it easier for you to maintain your preferences on the Website, and by seeing how you use the Website, we can tailor the Website around your preferences and measure usability of the Website. You can, should you choose to, disable cookies in your browser and delete all cookies currently stored on your computer. You can find out how to do this by modifying your browser’s preferences appropriately.

In general, you may navigate the Showthemes website without directly providing us with any personal information. Any domain name information that we collect is not used to personally identify you but is instead aggregated to measure the number of visits, average time spent on the Website and the web pages viewed. We use this information to measure Website use and to improve its contents. However, additional services may be only available if we have certain information about you.

We may collect the following personal information from you:

  • Information about the Showthemes products you express an interest in or may purchase from us;
  • Your name and contact information, including email address and company details which you may submit to us when you interact with the Website;
  • Information about your location or similar location based information;
  • Information regarding your personal or professional interests, opinions, demographics, experiences with Showthemes and contact preferences in order to provide you with further correspondence about Showthemes.

We use your personal information for the following reasons:

  • To provide Showthemes products you have requested and to notify you about important changes to the Website;
  • To respond to your inquiries and complaints or to process your requests in relation to your information;
  • To follow up on any inquiries and complaints as part of our customer care procedures;
  • To update our records about you and for the purpose of retaining records about you;
  • To communicate with you in the course of our ordinary business activities;
  • To improve Showthemes products by making them easier to use and by providing access to certain sections of the Website;
  • To prevent or detect any unlawful activities; and
  • To evaluate the effectiveness of our marketing and for the purposes of research, training and statistical analysis in order to improve our service.

Should we request any personal information from you, we will furnish you with details on how the personal information you provide will be used.

We may contact you by e-mail, phone or post for the purposes set out in this section. By submitting such information to us, you are deemed to have agreed to us contacting you using these methods of communication. We will continue to contact you using the methods you choose until you advise us in writing that you no longer wish to be contacted using such methods. Please note that you are required to accept at least one of the above methods as your chosen method of receipt of communication from us.

We will not transfer, disclose, sell, distribute or lease your personal information to 3rd Parties other than on the following basis:

  • Where we have your consent to do so for the purpose of providing a service to you;
  • Where it is required by Showthemes’ Associates who may, directly or indirectly, render certain services to us or to you or in undertaking activities linked to the operation of such services on our behalf; or
  • Where the disclosure is in compliance with legal and/or contractual requirements that we are subject to, including, but not limited to, intergovernmental agreements.

We will not pass your personal information to 3rd Parties (other than on the basis set out in this Policy and in accordance with appropriate disclosure requirements we may be subject to) without your consent.

If you think that any personal information we hold about you is incorrect or incomplete, please write to or e-mail us as soon as possible. We will take the necessary steps to ensure that your personal information is corrected and/or updated.

16. Warranty

Showthemes gives no warranty or guarantee for our themes and extensions in any manner. Browser compatibility should be tested viewing the demonstration installations on the demo sites. Please ensure that your browser works with the theme. We support from IE9 onwards and the latest versions of Safari, Chrome and Firefox. We do not support IE6, 7 and 8.

We do NOT guarantee that our products will work with all 3rd party extensions. Our themes are developed for the latest WordPress version. Whether our products will work with future WordPress versions or how long past WordPress versions are going to be supported is not  guaranteed.

17. Disclaimers, Limitation of Liability and Indemnity

To the fullest extent permissible by law, we disclaim all warranties of any kind, whether express or implied in respect of the Showthemes products and Support Help Desk and you use the Showthemes service at your own risk.

You agree that neither we or our Associates shall be liable for any losses which you may sustain however arising and whatever the cause, in particular pursuant to your or any 3rd Party’s use of, access to and/or interference with the Showthemes service.

You also agree that our liability to you pursuant to these Use Terms shall furthermore be limited to the total amount of the fees you paid for your Showthemes service use.

You and any 3rd Parties using Showthemes products or Support Help Desk indemnify us and our Associates from any losses, which may arise as a result of your or the 3rd Party’s unlawful conduct, wilful misconduct and/or gross negligence.

18. Terms & Conditions

Showthemes reserves the right to change or modify current Terms Of Use at any time with no prior notice. Therefore, we encourage you to review changes to our privacy policy every time you visit this website. showthemes.com shall not be liable to you or any third party should showthemes.com exercise its right to modify, suspend, limit or discontinue any feature of the license.
